What is COOL?

COOL - Compact OSADL Online Lectures: Open Source meets Industry

  • COOL is an OSADL webinar series.
  • COOL takes place regularly once a month and covers new and emerging topics on Open Source software in industry, either on legal or on technical aspects.
  • COOL editions each consist of two lectures covering a special "Open Source meets industry" topic followed by a discussion round. The first "basic" or "theorectical" lecture provides basic knowledge with regard to the respective topic and the second "advanced" pt "practical" lecture dives deeper into the topic and highlights special aspects. The discussion round gives all participants the possibility to ask questions and discuss with the respective speakers and the audience.
  • COOL speakers are OSADL experts on the one hand and external specialists on the other hand who kindly agreed to share their expert knowledge on the respective topic.
  • COOL is a virtual event. The lectures are held by live video streams. Speakers will be available for questions and discussion in a video conference which will take part subsequent to the live video streams.
  • COOL in general is designed to provide support how to best and compliantly use Open Source software in industry.

Description COOL January 2026 edition:

The principle of exhaustion is a concept of intellectual property law that enables the marketability of goods. In short, it says that after the first legitimate sale of a protected work within the EU and EEA, this copy of the work may be passed on without additional permission by the rights holder. Its application to software and especially FOSS requires some interpretation of the law and of court decisions. For example, exhaustion may apply to software that was already installed in a device when it was first purchased and is then resold unchanged and not installed elsewhere, such as the car entertainment system in a used car or the operating system of a resold used internet router. In both cases, it is not the seller of the used goods who must fulfill the license obligations, but the party who originally placed the software on the market after the last modification, i.e. in the example the car manufacturer or the router manufacturer.

In the first session of this COOL, OSADL's General Counsel, Dr. Till Jaeger, will introduce the principle of exhaustion in copyright law and explain the particularities of applying it to software. Furthermore, he will give the statutory requirements and their legal consequences. Finally, he will clarify the relationship with contract law and give some hints on exhaustion of trademark law.

In the second session, Dr. Till Jaeger and Caren Kresse will discuss some scenarios of applying the principle of exhaustion to the distribution of FOSS in industrial products. For this, they will look at use cases from typical industrial supply chains, present the key elements of the scenarios and explore variants from clear-cut cases to gray areas. Along the way, best practices on exhaustion in the supply chain will be presented as they emerge.

Recommended audience COOL January 2026 edition:

Open Source compliance officers, software developers and engineers, system integrators, internal and external legal advisors, QA responsibles, etc.
